A BETTER WORLD AWARDS PROGRAM: Official Rules

 

ELIGIBILITY/HOW TO ENTER

No Purchase Necessary.

Nominees must be legally registered 501-3c nonprofit organizations headquartered in one of the 50 United States or the District of Columbia who receive at least 50% of their operating funds from private donations. Nominees must be actively involved in their respective charter purpose at the time of nomination. Nominees activities/services may take place anywhere in the world. The foregoing as well as all eligibility determinations relating to Nominees shall be at the sole discretion of Sponsor.

Nominations for "A Better World" awards program (the "Program") begin on October 17, 2006 and end on March 31, 2007 (the "Entry Period"). All online nominations must be received by 12:00 PM (ET) on March 31, 2007. All mailed nominations must be post marked by March 25, 2007 and received by March 30, 2007. The Program is sponsored by ReZoom, LLC, 7003 Chadwick, Suite 331, Brentwood, TN 37027. Employees, Board and Committee members of Sponsor and their immediate family members and/or those living in the same household of each of the foregoing are not eligible to nominate. All nomination submissions (each, a "Submission") must provide required information for the nonprofit organization being nominated as stated on the A Better World nomination form found at www.rezoom.com/abetterworld/. All Submissions (including all elements thereof) must be in the English language. Nominees may nominate themselves. Submissions cannot be offensive, nor can they defame any party or invade upon the publicity rights or privacy of any person, or otherwise infringe upon any person or entity's personal or proprietary rights, as determined by Sponsor in its absolute discretion.

There are two methods of entry:

Method #1: To enter online, visit www.rezoom.com/abetterworld/ to fill out the appropriate nomination form and follow the online instructions to submit your nomination and essay (400 word limit) online.

Method #2: To enter by postal mail, submit all required information found on the "A Better World" nomination form at www.rezoom.com/abetterworld/ by first class mail, with proper postage affixed, to: A Better World, C/O ReZoom.com, 7003 Chadwick, Suite 331, Brentwood, TN 37027.

Multiple entries for the same Nominee are allowed. Individuals may also nominate more than one nonprofit organization. Sponsor is not responsible for technical failures in entry transmission, or for lost, late, misdirected, damaged, incomplete, illegible, mutilated, or postage due mail. Incomplete nominations and those not complying with all rules are subject to disqualification at the sole discretion of Sponsor. No mechanically reproduced nominations allowed. Once submitted, all nominations become the property of Sponsors and will not be returned.

SELECTION OF REGIONAL AWARD WINNERS

An Award of $5,000 will be made in each of (20) Regions within the United States.
One (1) additional "At Large" charity will be selected to receive a $5,000 award and will also be eligible for the $100,000 National Award.

The 20 Regions are:

14. Georgia, South Carolina
15. North Carolina, Virginia
16. West Virginia, Maryland
17. Washington DC, Delaware
18. Pennsylvania, New Jersey
19. New York, Connecticut
20. Massachusetts, Rhode Island, Vermont, New Hampshire, Maine

Voting for the Regional Nominees begins at 12:00am (ET) on March 1, 2007, and ends at 12:00 pm (ET) on March 31, 2007. Anyone is eligible to vote by going to www.rezoom.com/abetterworld/ and following the instructions for casting votes. An individual may vote for more than one (1) Nominee, however only one (1) vote per e-mail address per day is allowed.

Fifteen potential Award Winners (each, a "Nominee") will be selected from among the eligible nominations received to be judged for a Regional Award – Ten (10) will be those with the highest vote total during the Regional Voting round, and five (5) will be at-large "Editor's Choice" selections. Nominations will be judged by representatives of Sponsor based on the following criteria: 1) Core activity of the nonprofit (30%) – Do the Nominee's activities address a real need or concern? Is there demonstrated impact resulting from the Nominee's activities? 2) Innovative service methods (20%) - Do the Nominee's activities reflect innovative approaches or unique solutions. 3) Quality of Essay (50%) – How effective is the essay in describing the mission, the actions, and the positive contribution of the Nominee to build a better world. In the event of a tie, the affected nominations will be re-judged by an additional judge who will serve as a tiebreaker and evaluate these nominations according to the criteria listed above. The essay portion of the nomination form must be in keeping with the Sponsor's image and may not be offensive nor can they defame or invade upon the publicity rights or privacy of any person or otherwise infringe upon any person or entity's personal or proprietary rights, as determined by the Sponsor in its sole discretion. A Nominator may submit a Nominee without including an essay with the submission. However, the essay portion comprises a large portion of the judges' criteria; therefore the likelihood of receiving an Award is greatly reduced without an essay submission.

Regional Award Winners will be notified by telephone and/or mail on or about April 24, 2007. The decision of the Sponsor is final and binding.

SELECTION OF NATIONAL AWARD WINNER

An Award of $100,000 will be presented to the A Better World National Award Winner. Each of the twenty (20) Regional Award Winners as well as the "At Large" winner will be eligible for the National Award. The National Award Winner will be determined by a National voting round. The dates for National Award voting will be announced within 30 days of the completion of Regional voting. The Regional Award Winner receiving the most votes during the National voting round will be the National Award Winner. Votes received during the Regional voting round will not carry over to the National voting round. Anyone is eligible to vote by going to www.rezoom.com/abetterworld/ and following the instructions for casting votes. An individual may vote for more than one (1) Regional Award Winner; however only one (1) vote per e-mail address per day is allowed.

If a ceremony is held to present the Awards to the Nation Award Winner, Sponsor shall provide the following for the National Award Winner: (a) round trip coach airfare (for the nonprofit organization's Director and a guest) to and from the city of the award ceremony (if Honoree's city of residence is within 100 miles of the ceremony location, alternate transportation may be provided); (b) ground transportation to and from airport; (c) standard hotel accommodations (double occupancy) in city where ceremony will be held. Meals, gratuities, other ground transportation, miscellaneous expenses and all other costs and expenses not listed as part of the Award are the sole responsibility of the National Award Winner. Without in any way limiting the foregoing, all taxes on the Awards, if any, are the sole responsibility of Award Winners. Sponsor recommends that Award Winners consult a tax advisor regarding any tax consequences relating to acceptance of the Awards. The Awards are not transferable. By entering, all participants agree to be bound by the Official Rules and by the decisions of the judges, which shall be final and binding on all matters relating to this Program.

MISCELLANEOUS
By participating, Nominators and Award Recipients agree irrevocably to assign and transfer all rights, title and interest (including without limitation any copyrights) in and to the Submission, and all elements thereof (including without limitation any photos and/or video) to Sponsor. Nominators and Award Recipients agree that the Submission (including without limitation the photos and/or video) will be owned by the Sponsor and its designees shall have the right to publish, use, adapt, edit and/or modify such nomination in any way including in commerce and in any and all media worldwide, including but not limited to the Internet, without limitation and without compensation to the Nominator or Award Recipient. Without limiting the foregoing, submitting a nomination for the Award constitutes permission for Sponsor and their respective affiliates to use Nominators' name, city and state of residence, likeness, photos, essays, and other information provided by Nominators in the Submission in any and all media worldwide (including without limitation TV, print and the Internet) for advertising and promotional purposes as Sponsor determines in its sole discretion without notice or further compensation, except where prohibited by law. Nominators, Award Winners agree to confirm the foregoing awards in writing upon Sponsor's request and to cooperate with Sponsor by executing any additional documents Sponsor deems necessary in its discretion to secure all rights needed for Sponsor to use nomination materials for advertising and/or promotional purposes. Failure to confirm these awards in writing may result in disqualification of the Nominee, at Sponsor's sole discretion. Nominators and Award Winners may be featured in follow-up promotional materials and activities of Sponsor. If Nominator is a minor, parent or legal guardian must provide permission to enter this Program and to consent to the use of information from the registration as provided in these Rules.

Sponsor reserves the right to modify and/or edit any nomination copy for the purpose of press releases and for feature stories in publications. By participating in the Award program, Nominators and Nominees acknowledge and agree that publication of a nomination or story on the ReZoom.com site or in any other media during the submission period in no way indicates that a nomination has been selected to receive an award.

The Nominator and Nominee may be required to sign and return an Affidavit of Eligibility, Liability, and where legally permissible, Publicity Release. Nominee may be disqualified (at the absolute discretion of Sponsor) if any such documentation is not received within the time period requested in correspondence from the Sponsor. The Award may be forfeited and an alternate Nominee selected, if notification letter is returned as undeliverable or potential Award Winner cannot be contacted.

In the event that a selected Nominee declines to accept an Award, an alternate Nominee may be selected. By submitting a completed nomination form, Nominator represents and warrants to the Sponsor that: (1) Submission is Nominator's original work, (2) no nomination materials infringe upon or violate, nor will they infringe upon or violate, the rights of any third party

By entering the Program and/or accepting an Award, Nominators, Award Winners release Sponsor, their respective parent companies, affiliates, subsidiaries, and the employees, officers, directors, shareholders, agents and advertising, promotional or judging agencies of each of the foregoing ("Releasees") from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership, possession, use, misuse, loss, or misdirection of any Award, or while preparing for, participating in, and/or traveling to or from any Program-related activity. Releasees are not responsible for any typographical or other errors in printing, the offering or administration of the Program, or in the announcement, presentation or acceptance of Awards. All federal, state and local laws and regulations apply. Void in Puerto Rico and where prohibited. By participating, Nominators and Nominees agree to be bound by these Official Rules and accept the decisions of the Sponsor as final in all matters relating to the Program. Proof of mailing does not constitute proof of delivery.

Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Nominator, Nominee and/or Sponsor in connection with this Program, shall be governed by and construed in accordance with, the laws of the State of Tennessee without giving effect to any choice of law or conflict of law rules (whether of the State of Tennessee, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Tennessee. In addition, any dispute relating to the Program (including these Official Rules) shall be brought in the appropriate state or federal court having jurisdiction over the subject matter located in the City and County of Tennessee. Nominators, Nominees hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non conveniens or lack of personal jurisdiction they may have.

In the event of a dispute over the identity of an online Nominator, the nomination will be deemed submitted by the "Authorized Account Holder" of the e-mail address submitted at time of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Nomination materials/data that have been tampered with or altered, or mass nominations, or nominations generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for any error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of nomination materials, or for technical, network, telephone equipment, electronic computer hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive nomination information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination therefore, or any injury or damage to Nominator's or any other person's computer related to or resulting from participating in the Program. If for any reason the Internet portion of the Program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other causes beyond the control of the Sponsors, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Program, Sponsors reserve the right, at their sole discretion, to disqualify any individual who tampers with the nomination process and to cancel, terminate, modify or suspend the Program without any liability to any Nominator, Nominee or participant. Sponsors reserve the right to select Award winners from eligible nominations received as of the termination date.

CAUTION: ANY ATTEMPT BY A NOMINATOR AND/OR NOMINEE TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE AWARD PROGRAM IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH NOMINATOR AND/OR NOMINEE TO THE FULLEST EXTENT OF THE LAW.
